How come my DUI from 5 yrs ago did not show the criminal background check?

I got a DUI about 5 yrs ago, blew a .05 and I ran a criminal Background Check on myself on Intelius and nothing was found. Am I in the clear when a potential employer runs a background check? On the application, should I disclose the DUI or not?
Sorry, forgot to say that this was in Queens NY and that I had pleaded guilty.

Were you convicted in court of a DUI? If your employer asks, then you should be honest. It will probably show up in a background check through court records. You could check online to see if there are open court records for your county or check at your county court in person.

What exactly comes up in a criminal background check?

I am looking for some information as yo what comes up in a criminal Background Check.
Obviously if you were convicted of a felony that should be on there but what other things?
Credit score? Termination from a past employer?

Also how far does a Criminal Background Check go back?

A CCH (Computerized Criminal History) will show your adult arrest record…all the wheres, whens, and what fors. No credit or job history, only criminal records. Oh…it goes back to your first adult arrest, and lasts forever.

Can you see the court discovery in a criminal background check?

When you go to apply for a job or an apartment and they ask you for your criminal background, if they do a Background Check on you, do they have access to the discovery? The part that says what happened, how it happened and etc. Or can they only see what the criminal offense is.

It depends.

Technically that information would be a matter of public record, so if the potential employer or landlord really WANTS to take the time, effort and effort to do a Public Records request they CAN. But this is very unusual.

The normal Criminal Background Check just reveals convictions with the dates of the offenses.

Can a open criminal case show up for a job background check?

I recently got arrested for the first time ever in May and its a open case. I wanna start applying to jobs. Will it show up in a criminal Background Check? Should I say i didn’t get arrested since im not convicted yet? Or just tell the truth and explain to the employer??

Employers or potential employers can get information about your criminal record from a credit report, the state police and/or from a record check on a national level. In most cases, the employer must first get your permission in writing.

In general, the employer can find out about:
- arrests during the last seven years, and
- any convictions (no matter when it occurred), unless they were erased.

I need to get a non-fingerprint (meaning getting my fingerprints taken isn’t a requirement) criminal record check/background check for a company in Japan that is hiring me. I’m in Los Angeles county and an internet Background Check is not acceptable. Does anyone know where I can go to get this done? Thanks.

You could go to your county’s police station for your criminal background record or to nbi agency and request a criminal background record / document from them that you would need for your job application in Japan. Good luck!

Can an attorney general perform a criminal background check on me without a reasonable cause or my consent?

A person I know asked her boyfriend to run a Criminal Background Check on me. Her boyfriend’s father happens to be the Attorney General in the state I reside in. Was this action legal? Even if it was, I’d like to know my rights regarding this matter. Thanks!

Anybody can able to do a background check on you. As a matter of fact, there are lots of existing background criminal record websites available online. If you think it is illegal to conduct a background check to a person without his consent then, why is it online Background Check is not prohibited?

I want to conduct a Criminal Background Check on someone and most of the sites ive been to are bogus. I don’t mind paying a small fee but free would be better.

While it’s true that there are literally hundreds of criminal Background Check service websites online, many of them can’t stack up to the big three which are US Search, Intelius and Net Detective.

Those three have been in business the longest and have the most extensive databases…

That website has some great information about the good, bad and the ugly of the background check industry and should help you make an informed decision.

On a side note, each of these services does charge a small fee BUT you won’t find a for profit background check company that doesn’t. Even if you come across a service that claims to provide a "Free Search", you will still have to pay to see the results.

Okay so I had a job interview from jc penny and they told me that I will get hired after a criminal background check. My question is when they say the will be conducting a criminal Background Check do the only check for criminality (which I have none) or do they check on everything in my life? What exactly do they check for??

they’ll check your credit, work history & references in addition to criminal history.

So its more than just a Criminal Background Check.

I got a call yesterday (10-24-2010) and was offered a job and was asked to start Thursday! But first they have to do a Criminal Background Check how long does this usually take should i expect a call tomorrow (10-26-2010) or Wednesday?

Depends. The state Background Checks are 3-7 days and the FBI checks are a few weeks.

Why Employers Should Care About Criminal Records

If you are an employer, your task is not limited to finding competent people who can deliver a good job. You are also responsible for hiring people who can maintain harmony in the workplace, socially interact well with their coworkers, and generally not pose a threat to the safety of both clients and employees. Thus, you should look beyond character references, transcripts of records, certificates of employment. You better take a look whether or not criminal records exist for an applicant.

The existence of criminal records alone should not be the sole reason to decline an applicant. Equal opportunity should be practiced in the workplace; besides, ex-convicts who have fully rehabilitated while in prison deserve a second chance. But that’s exactly what you need to look for—an assurance that the applicant who has criminal records already turned over a new leaf and put his criminal life behind him. You can also check his criminal records for documentations of mental instability. The last thing you want to happen is hiring a person who is capable of running amok at the slightest trigger.

However, in this dangerous world, hardened criminals lurk everywhere. If you do not pay much attention on criminal records, you may be hiring a repeat offender of a certain crime without even knowing. For example, if the applicant happens to be involved in several sexual harassment cases and this detail escaped your knowledge because you didn’t review his criminal records, how can you ensure the safety of your female employees? Criminal records are generally available to the public so there’s really no excuse for you not to go over them with each applicant you have in your roster. More recent criminal records are on the internet so you’ll have an easier time accessing them. Some sites even offer free access to criminal records, but if you are serious about doing a criminal Background Check, it’s more advisable for you to go for paid access to criminal records. With paid access, you are assured that you only get the latest, most updated, and complete criminal records. Free access sites, on the other hand, are not very reliable because the criminal records in their databases are not religiously updated. In this situation (and in most cases), you do get what you pay for.

Fees to paid access sites are often reasonable, so it’s really a minimal expense on the part of your company to spend on them in order to gain access to criminal records. Consider having access to criminal records an investment because after all, the people in your company are your greatest resources. You only want the best to be part of your team, and in order to achieve that, you have to be really careful and thorough during the selection process.
