How come my DUI from 5 yrs ago did not show the criminal background check?

I got a DUI about 5 yrs ago, blew a .05 and I ran a criminal Background Check on myself on Intelius and nothing was found. Am I in the clear when a potential employer runs a background check? On the application, should I disclose the DUI or not?
Sorry, forgot to say that this was in Queens NY and that I had pleaded guilty.

Were you convicted in court of a DUI? If your employer asks, then you should be honest. It will probably show up in a background check through court records. You could check online to see if there are open court records for your county or check at your county court in person.

    If the job specifies felony then no you don’t but if it says any criminal offense then yes.

    If its not on your criminal report you would be retarted to write it on your application. What state are you from were you get a DUI for .05 Utah?

    The background check you get from a company like Intelius is not the same as a background check that an potential employer runs. Intelius and sites like them use public records that are not verified for accuracy.
    A potential employer will use a background screening company that is compliant with The Fair Credit Reporting Act (FCRA). They can run a detailed criminal report all the way to the county level which in all likelihood will find your DUI.
